HON'BLE SRI JUSTICE S.V. BHATT CONTEMPT CASE No. 1513 OF 2013 ORDER:
The contempt case is filed complaining disobedience of order, dated 12.10.2012, in W.P.No.31889 of 2012. The operative portion of the impugned order reads as follows:
"Hence, the writ petition is disposed of, directing the 2nd respondent to complete the process of effecting mutation of the entries and issuance of pattadar pass book and title deeds, in respect of Ac.0.90 cents of land in survey No.173/2A of Anantavaram Village, in favour of the petitioner, within a period of two months from the date of receipt of a copy of this order."
The petitioner complains that in spite of positive direction from this Court, the contemnors have not complied with the Court direction and thus have committed contempt and rendered themselves liable for action under the Contempt of Courts Act, 1971. The 2nd respondent/contemnor filed counter affidavit and by way of reply it is stated that the allegation that the respondents did not act in the matter is erroneous for through proceedings Rc.No.DT/310/2011, dated 10.04.2013, the request for issuance of pattadar pass book and/or identification of property was rejected.
I have perused the material available on record. This Court is of the view that no case for proceeding further under Contempt of Courts Act is made out. The petitioner, if so advised, is given liberty to work out the relief, if any, available against endorsement, dated 10.04.2013. With the above observations, the contempt case is dismissed. No order as to costs. Miscellaneous petitions, if any, shall also stand dismissed.
