THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7963 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-accused Nos.2 under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.44 of 2016 on the file of Railway Kodur Police Station, YSR Kadapa District, registered for the offences punishable under Sections 324 and 307 r/w. 34 IPC.

Heard and perused the material available on record. The allegation against the petitioner is that he, along with other accused, beat the de facto complainant's husband with iron rods on head with an intention to kill him due to which he received bleeding injury, since he left their company and developed another company. Learned counsel for the petitioner submits that the petitioner is no way concerned with the alleged offences and he is falsely implicated in the case and there are no previous cases against him. Learned Additional Public Prosecutor opposed the bail application that the injured is still in the hospital and hence, it is not a fit case to grant anticipatory bail.

In view of the submission of the learned Additional Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioners at this stage.

Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J June 16, 2016.
