THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5655 of 2012 ORDER:

The petitioner states to be a businessman and social worker, who was elected as Ward Member in the Sarpanch elections held in the month of August 1995. He was also holding several other positions in Jukkal Constituency. However, he was involved in some criminal cases due to disputes among his family members. While so, a rowdy sheet was opened against him vide proceedings dated 27.05.2011 of respondent No.2. Challenging the same, the present writ petition was filed. The learned Government Pleader for Home (TG) on the basis of written instructions submits that the petitioner was involved in 13 cases and the latest case is Cr. No.13 of 2015 wherein he is facing trial in C.C. No.67 of 2015 and rest of the cases were closed against the petitioner.

Thus, it is clear that the petitioner is facing trial only in one case and it cannot be a ground for continuance of rowdy sheet against the petitioner.

In the circumstances, this Writ Petition is disposed of directing respondent No.2 to review the cases against the petitioner and take a decision with regard to continuance of rowdy sheet and pass appropriate orders thereon in accordance with law within a period of three (3) months from the date of receipt of a copy of this order. No order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
