THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.28734 OF 2016 ORDER :

The case of the petitioner is respondents 5 and 6 filed a case being Rc.No.A2/7822/2013 before the 3rd respondent-RDO, Khammam, for issuance of occupancy rights certificate in respect of lands situated in Sy.No.425 and 432 of Velugumatla Village, Khammam Urban mandal, Khammam district.

Grievance of the petitioner is the said lands are ancestral lands and though he has a share in the lands, respondents 5 and 6 without making him as a party to the proceedings sought occupancy rights certificate for the entire lands. Petitioner states that for the purpose of impleading in the said proceedings filed by respondents 5 and 6, he filed two interlocutory applications, but the 3rd respondent is not taking up the applications nor passed any orders on the applications, but proceeding with the matter filed by the respondents 5 and 6.

Inasmuch as the grievance of the petitioner relates to nonconsideration of the interlocutory applications filed by him in proceedings in Rc.No.A2/7822/2013 before the 3rd respondentRDO, Khammam, suffice it direct the 3rd respondent to number the IAs said to have been filed by the petitioner and after issuing

notices to the parties concerned, decide the same in accordance with law.
