ORDER
This writ petition is filed seeking to declare the action of the respondents in not taking action against the accused in FIR Nos.130 of 2015, 149 & 217 of 2016 of Kadiri Town Police Station and also in not providing protection to life and property of the petitioner, as arbitrary and illegal.
Learned Government Pleader for Home, on written instructions, submits that in respect of Cr.No.130 of 2015, charge sheet was filed on 30.01.2016, which was numbered as PRC No.52 of 2016 on the file of Additional Judicial Magistrate of First Class, Kadiri and the case is pending for SC number. With regard to Cr.No.149 of 2016, dated 5.7.2016, investigation was completed and the case was referred to "as false". In respect of Cr.No.217 of 2016, dated 27.09.2016, nine witnesses were examined and their statements were recorded and investigation is in progress. In view of the same, it cannot be said that the respondents are not taking action on the said complaints.
Learned counsel appearing for the petitioner submits that there is a life threat to the petitioner and no protection is provided by the respondents.
It appears that no complaint or representation seeking protection is filed by the petitioner.
In the circumstances, it is for the petitioner to submit a representation to the respondent-police, if any protection is needed. As and when such representation is received, the police shall consider the same in accordance with law. Accordingly, the Writ Petition is disposed of. No costs.
