THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA TRANSFER CMP.Nos.431 AND 433 of 2016 COMMON ORDER:

Since the parties in both these petitions are same, both these transfer CMPs are being disposed of by this common order. Heard Sri Ghantasala Udaya Bhaskar, learned counsel for the petitioner - wife, and Sri V. Surender Reddy, learned counsel for the respondent - husband.

These two transfer CMPs are filed by the petitioner - wife to withdraw the respective G.O.Ps from the file of the Judge, Additional Family Court, Visakhapatnam, and to transfer the same to the file of the District Judge, Krishna at Machilipatnam, on the sole ground that the petitioner, mother of the children, is residing at Mopidevi village, Krishna District, and it would be difficult for her to travel to the Court of the Additional Family Judge at Visakhapatnam. Learned counsel for the respondent, while drawing the attention of this Court to the orders passed by this Court on 17.08.2016 complaining violation of the order of the Court below by the petitioner, would submit that in both G.O.Ps, trial is concluded and cases are coming up for arguments and, therefore, at this stage it is not desirable to accede to the reliefs sought for in the present petitions.

There is substance in the submissions made by the learned counsel for the respondent, for the reason that a Court, which conducts trial, would better appreciate the matters in controversy. Therefore, keeping in view, the submissions made by the learned counsel for the respondent

that trial in both G.O.Ps is completed, it has to be held that there is no merit in the present transfer CMPs.

Hence, the transfer CMPs are dismissed. No order as to costs. Miscellaneous Petitions, if any, pending in the present petitions, stand closed.
