THE HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO WRI T PETI TI ON NO.4784 OF 2018 ORDER:

This Writ Petition is filed challenging the action of the 4th respondent in threatening the petitioner to compromise O.S.No.243 of 2017 in spite of the petitioner being owner of the land of an extent of Ac.7.23 cents situated in Survey Nos.160/3 to 3E of Simharajapuram village accounts, Palasamudram Mandal, Chittoor district.

Learned Government Pleader, on the basis of written instructions, submitted that it is totally incorrect to say that the 4th respondent called the Writ Petitioner and asked him to compromise the matter with the respondents 5 and 6 in respect of the above property. He further stated that the respondents 2 to 4 never intervened in the peaceful possession and enjoyment of the schedule property.

In view of the said categorical statement made by the respondent No.4, no further orders are necessary in the present Writ Petition. However, with regard to the right of the petitioner as against the respondents 5 and 6, the same has to be considered in O.S.No.243 of 2017 pending on the file of the Senior Civil Judge, Puttur.

The Writ Petition is closed, accordingly.

Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
