THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5731 of 2019 O R D E R:

In this writ petition, petitioner challenges the action of respondent Nos.2 to 4 in not considering the representations, dated 30.01.2019 and 12.02.2019, submitted by him against the illegal constructions made by respondent No.5 herein and other owners of premises bearing Nos.6-3-351, 6-7-57/B, 6-7-21/A, 6-7-23/B, 6-7-23/B, 6-7-51/B, 6-7-97/B and 6-7-49/B of Bansilalpet, Secunderabad.

Heard learned counsel for the petitioner and learned Standing Counsel for respondent Nos.2 to 4.

The assertion of the petitioner is that respondent No.5 and other owners of the above said premises are making constructions without obtaining permission as mandated under the Municipal Laws. Except making the representations, the petitioner has not made any effort to obtain information from the Municipal Corporation as to whether any permission was granted in favour of respondent No.5 and other owners.

In those circumstances, this Court is not inclined to entertain the writ petition.

Hence, the writ petition is closed giving liberty to the petitioner to obtain information by invoking the provisions of the Right to Information Act, 2005 with respect to the particulars of the above

said premises on which respondent No.5 and others are making constructions. On receipt of such information, if the petitioner is satisfied that the constructions made by respondent No.5 and others are without permission, he is at liberty to invoke the jurisdiction of this Court.

Miscellaneous petitions, if any, pending in this writ petition shall also stand closed. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:20.03.2019 kdl
