SMT JUSTICE T.RAJANI CRIMINAL PETITON No.1738 OF 2018 ORDER:

This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking to enlarge the petitioner, who is sole accused, on bail in Crime No.05 of 2018, on the file of Doulathabad Police Station, Siddipet, Medak District, for the offences punishable under Sections 376(2)(1)(n) of IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The case of the prosecution is that the petitioner committed rape against the victim girl, who is mentally unsound. He went to the house and committed the said offence and the victim was not in a position to understand as what was happening. Later she complied stomach ache and when her father enquired about the happenings, then she revealed these things.

Hence, considering the above facts, this Court opines that this is not a fit case for grant of bail. 5.

Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 22.02.2018 SS
