THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.11872 of 2015 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the inaction of the respondents in shifting the existing 11 KV lines and N9 distribution transfer from Vinayaka Nagar, Old Town, Anantapur, though the respondents received the necessary charges, as illegal and arbitrary and consequently direct the respondents 3 to 5 to shift the Transformer from the existing place to 80 feet Road, Anantapur forthwith. Heard and perused the material.

Learned counsel for the petitioner submits that even though the respondents have received the required charges for shifting the Transformer from the place, where it is located, they have not shifted the same and as such, prays this Court to direct the respondents 3 to 5 to shift the Transformer forthwith.

Learned counsel appearing for the respondents submits that there is a dispute regarding the place where the Transformer is to be erected, and as such, they have not shifted the Transformer. On hearing both sides, the writ petition is disposed of with a direction to the petitioner to give a representation to the fourth respondent and on such representation, the fourth respondent is directed to consider the same and if the petitioner complies with all the Rules and Regulations and if there is no dispute with regard to the place, where the Transformer is to be erected, the respondents 3 to 5 are directed to shift the Transformer since the respondents have already received the necessary charges for shifting of the Transformer.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 23.04.2015 pln
