ORDER

This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioners who are arrayed as accused in Crime No.2449 of 2025 before the Narsingi Police Station, Ranga Reddy District, registered for the offence punishable under Sections 318(4), 338, 336(3), 340(2), and 329(3) of BNS.

The brief facts of the case are that the petitioners are accused in Crime No. 2449/2025 which arises from a complaint alleging that the petitioners fabricated documents relating to Plot No. 77, admeasuring 500 Sq. Yards in Sy. No.147, situated at Narsingi Village, Gandipet Mandal, Ranga Reddy District, and attempted to trespass into the land and dig a borewell. Based on this complaint, the police registered the crime and are seeking to arrest the petitioners. Aggrieved thereby, the petitioners have filed the present bail application.

Heard Sri Soma Ravi Kiran Reddy, learned counsel for petitioners, and Sri Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the registration of the crime is an abuse of process of law and unsustainable. He contended that the entire dispute pertains to title and ownership of immovable property, which is purely civil in nature, and the petitioners are bona

fide purchasers under registered documents. He further contended that the petitioners have not committed any act of forgery or fabrication, and the allegations are vague and general without specific overt acts. While averring that the case is based entirely on documentary evidence which is already available with the Sub-Registrar Office, and no recovery is required from the petitioners, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this Criminal Petition.

Learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for petitioners, and contended that the allegations against the petitioners are serious in nature, involving fabrication of documents and attempted trespass. He contended that although the petitioners project the dispute as civil, the case has criminal elements, since forged documents were allegedly created to usurp property. The investigation is at a preliminary stage, and custodial interrogation of the petitioner may be necessary. Therefore, he prayed the Court to dismiss the criminal petition.

Having regard to the rival submissions and material on record, it is noted that petitioners are the subsequent purchasers and the original document of subject land pertains to the year 1979 and since then several transactions have taken place.

Considering the circumstances of the case in entirety, this Court deems it fit to grant pre-arrest bail to the petitioners subject to the following conditions:

i.

The petitioners shall surrender before the Station House Officer, Narsingi Police Station, Ranga Reddy District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/-, with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the

Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
