THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M. SEETHARAMA MURTI WRI T PETI TI ON No.4766 of 2004 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed by the Postal Department authorities along with the Union of India challenging the order dated 09.10.2003 passed by the Central Administrative Tribunal, Hyderabad Bench, in O.A.No.1374 of 2002.
The respondent/applicant appeared through Sri K. Venkateswara Rao, learned counsel on caveat.
Interim order dated 16.03.2004 was granted by this Court staying the order under challenge and also the proposed recovery. Sri K. Venkateswara Rao, learned counsel, informs this Court today that the sole respondent/applicant expired four to five years ago. Sri B. Narayana Reddy, learned Assistant Solicitor General for India, states that he has no information in this regard. As the writ petition stands abated owing to the death of the sole respondent/applicant, the cause does not survive for consideration on merits at this late stage.
The writ petition is accordingly dismissed.
Interim order dated 16.03.2004 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
