ORDER:
This writ petition is filed with the grievance that respondent No.2 has not been releasing the petitioner's tractor and trailor bearing registration No.AP 22H 5595 and AP 22H 5602 respectively. The petitioner pleaded that the aforesaid vehicles were seized by respondent No.2 on 30.11.2015, when they were proceeding at the outskirts of Kannaipally Village with the load of sand and were kept in the custody of the said respondent. The petitioner further averred that F.I.R.No.163 of 2015 of Kothakota Police Station, Mahaboobnagar District, was registered by respondent No.2 and that on coming to know about the same, he has paid penalty of Rs.5,000/-. As the seized vehicles have not been released by respondent No.2, the petitioner has filed this writ petition.
In the above facts of the matter, the petitioner is permitted to make an application before respondent No.2 for release of the seized vehicles along with the evidence showing payment of penalty. If such an application is filed, respondent No.2 shall examine the same, take an appropriate decision and communicate the same to the petitioner, within a period of three days of receipt of such application. Subject to the above directions, the Writ Petition is disposed of. As a sequel to disposal the writ petition, W.P.M.P.No.2208 of 2016 filed by the petitioner for interim relief shall stand disposed of as infructuous.
