THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38671 OF 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 1 and 2 in trying to interfere with the petitioner's life and liberty regarding civil disputes in respect of the land admeasuring 150 sq. yards in survey No.391 situated at Thimmapur Village, Mandamari Mandal, Adilabad District (Now Mancherial District) as illegal and arbitrary and consequently, to direct the respondents 1 and 2 not to interfere with the petitioner's life and liberty.
Heard and perused the material.
Learned counsel for the petitioner submits that without therebeing any complaint registered against the petitioner, the respondents 1 and 2 are trying to interfere with the petitioner's life and liberty and as such, he prays this Court to direct the respondents 1 and 2 not to interfere with the petitioner's life and liberty.
Learned Assistant Government Pleader for Home (Telangana) submits that the respondents 1 and 2 are not interfering with the affairs of the petitioner and he will follow due process of law.
Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to the respondents 1 and 2 not to interfere in the petitioner's life and liberty. The respondents 1 and 2 are further directed to follow due process of law laid down in Code of Criminal Procedure. The writ petition is accordingly disposed of.
