THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No.25041 of 2002 ORDER:

This writ petition is filed seeking a writ of mandamus declaring the action of the respondents 1 and 2 in not initiating conciliation proceedings under Section 12 of the Industrial Disputes Act, as arbitrary, illegal, and sought for a consequential direction to the respondents to initiate conciliation proceedings in respect of Charter of Demands submitted by the petitioner-Sangh, vide letter dated 20.3.2002. 2.

Heard Smt. K.Udayasri, counsel for the petitioner and the Government Pleader for Labour.

It has been contended by the petitioner-Mazdoor Sangh that they have raised a Charter of Demands before the management and when the management has not agreed with their demands, they have raised a dispute before the Conciliation Officer, vide order dated 20.03.2002. The grievance of the petitioner-Sangh is that the Conciliation Officer has not entertained the said dispute. Aggrieved by the same, the present writ petition is filed.

This Court is of the considered view that this writ petition can be disposed of, directing the Conciliation Officer to initiate conciliation proceedings on the Charter of Demands submitted by the petitionerSangh on 20.03.2002, within a period of six weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of, directing the Conciliation Officer to initiate conciliation proceedings on the Charter of Demands submitted by the petitioner-Sangh on 20.03.2002, within a
