THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.1808 OF 2018 ORDER:
This petition is filed by the petitioner-A2 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.45 of 2017 on the file of the Station House Officer, Kanipakam Police Station, Chittoor District, which was registered for the offence punishable under Section 468 r/w 34 IPC. 2.
Heard learned counsel for the petitioner, learned Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner would submit that already so many similar complaints were made with regard to the certificates filed by the petitioner-A2. The same were enquired by the Officers concerned and thereafter, closed the proceedings.

It is brought to the notice of this Court that the Executive Officer of the temple, after enquiry, addressed letters dated 26-04-2012 and 06-04-2017 stating that on verification of the certificates submitted by the staff, they are found genuine and the Executive Officer requested the S.H.O. to take action against the persons who gave complaints. The truth or otherwise of the allegations made in this crime is required to be examined. So also, the genuineness of the said certificates is required to be determined. Therefore, the Investigating Officer shall enquire with regard to those certificates in the course of investigation and after completion of investigation, file charge sheet or final report as the case may be.

With the above observation, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
