HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY Crl.P. No.1950 OF 2018 ORDER:

This criminal petition is filed under Section 439(2) Cr.P.C. to cancel the anticipatory bail granted on 16.08.2017 in Crl.M.P.No.3111 of 2017 in C.C.No.3586 of 2013 by the XV Additional Sessions Judge, Ranga Reddy District, Kukatpally at Miyapur to the 2nd respondent/A1 on the ground that the petitioner avoided his arrest by the police for avoiding trial of the case since long time.

Learned counsel for the 2nd respondent filed undertaking affidavit of the 2nd respondent/accused before this Court that the petitioner will not leave India for six months from the date of filing affidavit i.e. 28.03.2018. In view of the undertaking affidavit filed by counsel for the 2nd respondent that the petitioner will not leave India for a period of six months form the date of petition, the XIV Metropolitan Magistrate, Kukatpally, at Miyapur is directed to dispose of C.C.No.3586 of 2017 within five months from today in accordance with law.

With the above direction, the criminal petition is disposed of without touching the merits of the case.

Pending miscellaneous petitions in the petition, if any, shall stand closed.
