HONOURABLE SRI JUSTICE S.V.BHATT WRIT PETITION Nos.34166, 34291, 34293 and 34297 OF 2012 COMMON ORDER:

Heard Miss. G.Sudha, counsel for petitioners and Assistant Government Pleader (Labour), and Sri K.V.Satya Ramachandra Rao, counsel for 2nd respondent.

The Assistant Government Pleader places on record letter No.B/654/2017/15-3-2017 addressed by the Joint Commissioner of Labour to the Assistant Commissioner of Labour-III, Hyderabad, permitting the Assistant Commissioner of Labour to withdraw the cases filed by first respondent against petitioners herein. The Assistant Government Pleader submits that steps are taken for getting the cases withdrawn. The steps to withdraw could not be taken up and completed by Assistant Commissioner of Labour in view of the interim order granted by this court. The counsel for 2nd respondent submits that there is urgency for settlement and the workmen are entitled to a few monetary benefits thereunder. The counsel for petitioners submits that now the issue is substantially settled and the department has taken a decision for withdrawing cases and the presence of petitioners herein is dispensed with.

Statement is placed on record.

The Writ Petition is disposed of by this order. The letter No. B/654/2017/15-3-2017 addressed by the Joint Commissioner of Labour to the Assistant Commissioner of Labour-III, Hyderabad,

dated 15-3-2017, is taken on file. First respondent is given liberty to take further steps as are warranted for withdrawing the cases. The presence of petitioners before trial court, for that matter, need not be insisted upon while withdrawing the cases referred to vide letter No. B/654/2017/15-3-2017 addressed by the Joint Commissioner of Labour to the Assistant Commissioner of Labour-III, Hyderabad dated 15-3-2017.

The Writ Petitions are disposed of accordingly. No order as to costs.

As a sequel to the disposal of this petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed. ________________ JUSTICE S.V.BHATT Dated 27-3-2017.
