This Criminal Petition is filed by the petitioner-Accused No.1 under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in FIR No.128 of 2015 on the file of Nereducherla Police Station, Nalgonda District, registered for the offence punishable under Section 307 r/w 34 IPC.

Heard and perused the material available on record. It is alleged that the petitioner along with A2 and A3 armed with iron roads, attacked on Yellaboina Venkaiah with an intention to kill him, due to previous disputes and all the accused beat him over his head, right leg and on the chest and on hearing the hues and cries of Venkaiah, when Boda Venkateshwarlu and his wife woke up and tried to rescue him, the accused beat them with iron rod. It is brought to the notice of this Court that the injured died and the section of law was altered to that of 302 IPC and some of the accused were arrested and the petitioner is yet to be arrested. Since the allegations are serious in nature, this Court is not inclined to grant anticipatory bail to the petitioner.
