HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN Civil Revision Petition No.2390 of 2017 ORDER:
The petitioner has come up with the above revision challenging the concurrent orders of the Courts below rejecting the prayer for interim injunction.
2. Heard Mr. P.V. Venkata Ravi Sankar, learned counsel for the petitioner.
3. The trial Court after granting a small reprieve dismissed the application for injunction way back on 10-02-2014. The Appellate Court confirmed the said order. The petitioner did not have the benefit of injunction for the past 3 years. Therefore, at this stage, it is not a case for the grant of injunction.
4. The suit itself appears to be a preemptive one to prevent the landlord from seeking eviction. The landlord has filed an eviction petition and the trial is in progress. Therefore, the question of granting an injunction does not arise especially when the landlord has taken recourse to legal remedies for eviction.
5. The Civil Revision Petition is dismissed. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. ________________________ V. RAMASUBRAMANIAN, J Date: 28-04-2017 Ksn
