THE HON'BLE SRI JUSTI CE A.V.SESHA SAI C.M.A.No.543 of 2013 ORDER:

On reference to the Lok Adalat, the Lok Adalat passed the following Award dated 13.8.2016.

"The above case between the parties having been referred for determination to the Lok Adalat and the parties having compromised the case/ matter, the following Award is passed in terms of the settlement. 1.

Sri D.Vilas, learned counsel for the Applicant and Sri Akshay Kumar Kulkarni, Legal Officer for ICICI Lambard General Insurance Company Limited. Both parties are present.

2. Both parties have amicably settled their dispute and in pursuance of the compromise , the applicant has agreed to forego 10% from the deposited amount of Rs.4,36,423/- which compromises the principal and interest as awarded by the learned Commissioner.

3. Accordingly, the award is passed for a sum of Rs.3,92,781/- in favour of the applicant together with accrued interest if any thereon in full quittance of his claim against the respondent/insurance company.

4. The respondent/insurance company shall be entitled for refund of amount of Rs.43,642/- with accrued interest thereon.

5. The applicant is permitted to withdraw entire amount.

6. In terms of the compromise arrived at between the parties, this case is disposed of.

7. The parties are informed that the court fee, if any, paid by any of them before lower court shall be refunded."

In view of the above, there shall be a Decree in accordance with the said Award. Accordingly, the CMA stands disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date: 21.9.2016 DA
