THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY Tr.C.M.P. No.445 of 2015 ORDER:

This transfer civil miscellaneous petition is filed under Section 24 of C.P.C., seeking to withdraw F.C.O.P.No.1255 of 2013 from the file of the Family Court, Visakhapatnam and transfer the same to any other Court in West Godavari District.

At the time of hearing, learned counsel for the respondent submitted that the trial Court dismissed F.C.O.P. No.1255 of 2013 for default. In view of the said submission, no further orders are necessary in this petition.

Hence, the transfer C.M.P., is closed. However, it is made clear that if ultimately the trial Court restored F.C.O.P. No.1255 of 2013 to its file, the petitioner is at liberty to file fresh transfer petition. Miscellaneous petitions if any pending in this petition shall stand closed.
