THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7388 of 2016 ORDER:
This criminal petition, under Section 438 of the Code of Criminal Procedure, is filed by the petitioner/accused seeking to grant bail in Crime No.123 of 2016 of Huzurabad Town Police Station, Karimnagar District, registered for the offences punishable under Sections 3(i)(r)(s) of Schedule Castes and Schedule Tribes (Prevention of Atrocities) Amendment Act, 2015 and Sections 290, 447 and 506 IPC.
Heard and perused the material available on record. The allegation against the petitioner is that on 06.05.2016 at about 15.30 hours, the accused along with other persons criminally trespassed into the land of the de facto complainant, damaged the compound wall and erected six cement poles in the said land. When the de facto complainant went to the spot, A-1 and A-2 abused him in filthy language and threatened to kill him with dire consequences. Learned Public Prosecutor opposed the bail application by submitting that there is a bar for grant of bail to the petitioner under the provisions of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Amendment Act.
In view of the submission of the learned Public Prosecutor, this Court is of the view that this is not a fit case to grant anticipatory bail. Hence, the Criminal Petition is dismissed.
