HONOURABLE SRI JUSTICE S.RAVI KUMAR SECOND APPEAL No.80 OF 1998 JUDGMENT:

As seen from the proceeding sheet, this court on 29-82011 passed orders that the appeals stand dismissed if the batta is not paid within two weeks to R.3 and R.4 without reference to the Court. The same is not complied. Without implementing that order, the case is listed now under "Final Hearing" caption showing that the appeal is already dismissed against R.3 and R.4 for default for not taking steps.

Advocate for appellants submitted that it is a reversing judgment whereunder the appellate court granted injunction in favour of plaintiff after considering the material and evidence on record.

As seen from the record, there is no substantial question of law involved in this case and the injunction granted by the appellate court is in force till this day and the entire grounds urged in the Second appeal are only in respect of factual aspects and for these reasons, I do not find any grounds to interfere with the findings of the appellate court.

Hence, this Second Appeal is dismissed.

As a sequel to the disposal of this appeal, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
