THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.4883 of 2018 ORDER:

In this Writ Petition, petitioners challenge notice, dated 07.02.2018, issued by the Panchayat Secretary, Gram Panchayat, Addatigala, directing them to demolish the unauthorized construction made by them in the land belongs to Gram Panchayat.

Though learned counsel for the petitioners submits that the impugned notice has been issued at the instance of the sixth respondent, in view of order, dated 28.01.2016, passed by this Court in Writ Petition No.3437 of 2015, wherein it has been directed that the fourth respondent therein should take further steps pursuant to the eviction notice, and evict the encroachers, if it was found that they have encroached the panchayat land, it is not necessary for this Court to consider various submissions of the learned counsel for the petitioners.

In those circumstances, in the interests of justice, this Court disposes of the Writ Petition by permitting the petitioners to submit an explanation to the impugned notice and put forward all their claims including the contentions raised in the present

CKR, J W.P.No.4883 of 2018 Writ Petition, before the fourth respondent, within a period of two (2) weeks from today. The fourth respondent is directed to consider the explanation of the petitioners and pass appropriate orders in accordance with law. Till passing such orders, further proceedings pursuant to the impugned notice are stayed. Miscellaneous Petitions, if any pending shall stand disposed of.
