HON'BLE SRI JUSTICE S.V. BHATT W.P.No.28615 OF 2015 ORDER:
The petitioner prays for the following relief: "......this Hon'ble Court may be pleased to issue a writ, order or direction, more particularly one in the nature of writ of mandamus declaring the action of the third respondent in issuing impugned notice vide Ref.D/161/2015 dated 06.04.2015 to the petitioner and trying to dispossess her from assigned land admeasuring Ac.1.35 cents in Survey No.53/7 situated in Rameswaram Village, H/o Aanuru in Peddapuram Mandal, East Godavari District as unjust, unreasonable, arbitrary, illegal and in violation of Article 21 of Constitution of India and consequently direct the respondents to call for the records to make proper enquiry and not to dispossess the petitioner and pass such other order or orders ...."
The 3rd respondent filed counter affidavit and states thus: "In reply to para 9 of the affidavit, it is submitted that, as per the records produced by the writ petitioner, the subject land was assigned to the writ petitioner in 1996 vide this office Ref.D/520/1996. But the same was not mutated in the original Assignment Register. It is submitted that, the then Tahsildar, Peddapuram why he has cancelled the D-patta issued to Sri Kollu Yesayya, s/o Padalu of Anuru village of Peddapuram Mandal and how he assigned the said land to writ petitioner was not known. After completion of the enquiry and verification of all the relevant records, action will be taken under intimation to the writ petitioner.
In reply to para 10 of the affidavit, it is submitted that, no action will be taken against the writ petitioner to dispossess from the land in S.No.53/7 measuring Ac.1-35 cents of Rameswaram Village of Peddapuram Mandal up to completion of the enquiry on the representation filed by Sri Kollu Yesayya, s/o Padalu of Anuru village of Pedda Mandal".
The statement is placed on record.
The writ petition is, accordingly, disposed of. The petitioner, if has a grievance of maintenance of revenue record or pahani/ adangal, is given liberty to represent to 3rd respondent for appropriate orders. There shall be no order as costs. Consequently, pending miscellaneous petitions, if any, stand closed.
