This writ petition is filed by a Company and its CEO and COO respectively alleging that the action of the Additional Inspector of Police and the Station House Officer, Rajendranagar Police Station in summoning the petitioners 2 and 3 to Rajendranagar Police Station without there being any complaint or crime registered against them is arbitrary and illegal.

Along with the writ petition, the petitioners filed a notice issued under Section 91/ 160 of the Criminal Procedure Code dated 24.03.2018. The notice refers to a complaint lodged by the complainant and direction to the petitioners to appear before the undersigned with documents. The second petitioner seems to have responded vide his letter dated 15.04.2018. Thereafter, this writ petition is filed alleging illegal interference by the police even though no crime is registered against petitioners 2 and 3. 3.

Learned Government Pleader, on instructions, submits that investigation is completed and final report is filed before the Court of the VIII Metropolitan Magistrate, Rajendranagar and the Court took cognizance of the final report and the case was numbered as CC.No.309 of 2019 wherein petitioners 2 and 3 are shown as A2 and A3.

That being so, no relief, as sought for, can be granted, at this stage, as the investigation is completed and charge sheet is

filed. If the petitioners have any grievance against showing them as the accused, they have to work out their remedies as available in law. Granting such liberty, the writ petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
