HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No.939 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

Mr.Ganta Rama Rao, learned Senior Counsel appearing for the appellant, does not press the writ appeal and seeks observation that if the appeal is filed by the appellants against the order, dated 19.03.2015, whereby the assignment of land, measuring 442 square feet in plot No.2 and 476 square feet in plot No.2, made in favour of appellants 1 and 2 respectively in Survey No.384, situated at Mandagiri Village, Adoni Mandal, Kurnool District is cancelled, the same may be directed to be considered on merits in accordance with law and uninfluenced by the observations made in the impugned order. Learned counsel for the respondents have no objection for making such observation.

In view thereof, the writ appeal is disposed of as not pressed with liberty to the appellants to file appropriate proceedings for redressal of their grievance against the order, dated 19.03.2015, impugned in W.P.No.20147 of 2015. It is needless to mention that the concerned authority/forum shall decide the proceedings that will be filed by the appellants against the order, dated 19.03.2015, on merits in accordance with law and uninfluenced by the observations made in the impugned order, dated 10.09.2015 passed in W.P.No.20147 of 2015.
