HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.1764 of 2018 ORDER:

This petition is filed under Section 482 Cr.P.C by the petitioner/A7 seeking to quash the proceedings against him in Crime No. 343 of 2012 of Narayanaguda Police Station, Hyderabad, registered for the offences under Sections 420, 463, 467, 468, 471 & 120-B IPC. The second respondent appeared and filed counter opposing the petition.

The compliant allegations in brief are that all the accused conspired together and created forged documents and sold the shares standing in the name of the complainant and received the proceeds. Investigation is reported to be pending.

Heard learned counsel for petitioner/A7.

Having regard to the gravity of the charge and pending investigation, it is not the fit case to quash the proceedings. Therefore, investigation shall lead to its logical conclusion. The investigating officer shall strictly follow the guidelines rendered by the Hon'ble Apex Court in Arnesh Kumar V. State of Bihar1 and follow the procedure contemplated under Section 41-A Cr.P.C., during the course of 1 (2014) 8 SCC 273

UDPR, J Crl.P No. 1764 OF 2018 investigation and shall complete the investigation expeditiously but not later than four months after receiving a copy of the order of this Court as the crime is of the year 2012. Petitioner/A7 in turn is directed to cooperate with the investigating agency for smooth completion of investigation.
