THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5071 of 2018 ORDER:

This Writ Petition is filed challenging the action of respondents 2 and 3 in not considering the application, dated 13.12.2017, for issuance of pattadar passbooks and title deeds in respect of land to an extent of Ac.3.36 cents in R.S.No.505/2, situated at Buttaigudem Village and Mandal, West Godavari District.

2.

Learned Government Pleader for Revenue appearing for the respondents received written instructions from the third respondent and he states that the application of the petitioner was received on 13.12.2017 and while conducting an enquiry, the brother-in-law of the petitioner filed an objection petition stating that the said land was not partitioned to any one of their family members and not to mutate the said extent in favour of the petitioner. The Village Revenue Officer and Mandal Revenue Inspector, Buttaigudem, also reported that the said land is under the possession and enjoyment of one Gadde Satyam for the last twenty (20) years and the petitioner was never in possession of the said land. Accordingly, the application of the petitioner was rejected. The applicant was informed orally to apply with valid documents and necessary action would be taken as per the rules in force.

3.

In view of the same, no further orders are necessary in the present Writ Petition. If the petitioner has not received the communication, she can approach the third respondent and obtain

copy of the said communication in order to enable her to take further action in accordance with law.

4.

With the above direction, the Writ Petition is closed. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________________ A.RAMALINGESWARA RAO, J FEBRUARY 26, 2018 YVL
