HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.25329 of 2017 ORDER:
This petition is filed for a writ of Mandamus declaring the action of the 4th respondent in suspending the petitioner vide orders in Lr.No.A/1500/2016, dated 15.07.2016, without specifying the time, period and also without approval from the respondents 2 and 3, as illegal and arbitrary and violation of Village Revenue Assistant Service Rules vide G.O.Ms.No.1849, dated 25.10.2005 and to set aside the same and for a consequential direction to the respondents to reinstate the petitioner into duty as Village Revenue Assistant. Learned Assistant Government Pleader for Revenue submits that the petitioner has been reinstated into service vide proceedings dated 01.08.2017, and as such, the cause in the writ petition does not survive.
Learned counsel for the petitioner submits that the petitioner is entitled for subsistence allowance during the suspension period.
Recording the aforesaid submission of the learned Assistant Government Pleader that the petitioner has been reinstated, the writ petition is dismissed as infructuous. However, the respondents are directed to consider payment of
subsistence allowance to the petitioner as per Rules, if not already paid. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any pending, shall stand closed.
