HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.4813 OF 2018 ORDER:

Heard the learned counsel for the petitioner, learned Government Pleader for Telangana Housing Board for respondent No.1 and Sri Vishweshwar Reddy, learned Standing counsel for respondents 2 and 3.

This writ petition is filed seeking the following relief :- "...............Writ of Mandamus declaring the inaction of the respondents for implementing the proceedings issued by the respondents vide Lr.No.Shops.E3/EE(c)/05, dated:07.02.2005 and GORT.No.95, dated:23.03.2006 as illegal, void, ultra virus and unconstitutional and consequently direct the respondents to execute the sale deed in favour of the petitioner in respect of Shop Nos.1 and 2, ground floor, situated at Manoranja Complex, M.J.Road, Hyderabad, T.S., in the interest of justice.............." It has been contended by the petitioner that he was the tenant of the Mulgie of the 2nd respondent and he has been paying the rents regularly. While so, the 1st respondent had issued G.O.Rt.No.93 dated 23.03.

2006 wherein a decision was taken by the respondents to sell the Mulgies in favour of the tenants. As such, he made a representation on 24.04.2017 requesting the respondents to extend the benefit of G.O.Rt.No.93. But so far, the respondents have not passed any orders on the said representation nor considered his case for extending the benefit of G.O.Rt.No.93.

Therefore, learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the

respondents to consider the case of the petitioner and pass appropriate orders in accordance with law.

Learned Standing counsel appearing for the respondents 2 and 3 contends that since the representation of the petitioner is pending with the respondents, the respondents would consider the same and pass appropriate orders in accordance with law. This Court, having considered the rival submissions of the learned counsel appearing for the respective parties is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 24.04.2017 and pass appropriate orders in accordance with law, within a period of eight (08) weeks from the date of receipt of a copy of this order.

With the above direction, this writ petition is disposed of. No order as to costs.
