SMT JUSTICE T.RAJANI CRIMINAL PETITON No.1812 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioners, who are A2 and A4, in Crime No.191 of 2016 on the file of Allagadda Rural Police Station, Kurnool District. The offences alleged are under Sections 420, 323, 506 r/w 34 IPC and Section 4(1)(r)(s) of SC/ST (POA) Amended Act, 2015.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

The case of the prosecution, which is reflected in the complaint filed by the defacto complainant, is that the complainant is doing commission business in cereals and food grains and he sold goods to A1 on commission basis and A1 is due amount towards the said transaction, but, he was not paying the amount and when he went and asked him for the amount, all the accused grew wild and bet the complainant, apart from abusing him in their caste name. 4.

Hence, considering the nature of allegations, this Court opines that this is not a fit case for grant of anticipatory bail. 5.

Accordingly, this criminal petition is dismissed.

However, the petitioners are at liberty to file a petition seeking for regular bail by surrendering themselves before the court below having the jurisdiction. The court below shall dispose

of the bail application on merits, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.
