708 of 2014 filed under Order XXXIX Rules 1 and 2 of the Code seeking a temporary injunction restraining the respondents/defendants from interfering with the plaintiff's peaceful possession and enjoyment of the immovable properties more-fully described in the schedules 'A' to 'C' annexed to the petition. 2. I have heard the submissions of the learned counsel for the appellants/petitioners/plaintiffs ('the plaintiffs' for brevity). As there was no representation for the defendants on 02.06.2015, the matter was directed to be listed on 03.06.2015 for hearing the submissions of the learned counsel for the defendants. As there was no representation for the defendants on 03.06.2015 also the matter was directed to be listed under the caption 'For Orders'. Despite so listing, there is no representation for the defendants.

Therefore, it is treated that there are no submissions to be made on behalf of the defendants. I have perused the material record. 3. The basic facts necessary for consideration in this appeal, in brief, are as follows: 3.1 According to the plaintiffs, the entire suit schedule property originally belonged to one S. Subhash Reddy. One Mohammad Shahabuddin purchased the schedule property from the said Subhash Reddy under registered sale deed dated 04.02.

2012 and that thereafter, the said Shahabuddin divided the property into three portions and had sold the same to the plaintiffs under different sale deeds and that from the date of the said purchases, the plaintiffs were and are in possession and enjoyment of the schedule property being absolute owners having right, title, interest and possession over the property and that the 1st defendant is the owner of open land with a room in survey No.30/1 admeasuring 375 Square yards having purchased the same from Subash Reddy under registered sale deed dated 20.05.2011 and that the property of the 1st defendant is within specific boundaries and that the 1st defendant had made that property into two portions and had sold the Northern portion of the house no. 2-5-29/21 admeasuring 200 Square Yards in Survey No.

30/1 to Nazia Begum and had also sold the Southern portion of the said house to Md.Ibrahim and that portion admeasures 175 Square yards is in Survey No.30/1 and that on the dates mentioned in the pleadings of the plaintiffs, the defendants along with a large number of associates, who are anti-social elements, came to the plaint schedule property and had tried to encroach into the plaint schedule property and that, therefore, the plaintiffs are constrained to file the suit for perpetual injunction and the application for temporary injunction. 3.

2 On the other hand, the second respondent filed a counter resisting the application for temporary injunction inter alia contending that the 1st plaintiff is the close relative of his daughter's husband and that the plaintiffs 2 and 3 are also close associates of the 1st plaintiff and that they are indulging in fraud by deceiving gullible people by creating documents to extract money illegally and are coercing the innocent people to fulfil their requirements and that the 1st defendant had colluded with the plaintiffs having been aware of the fact that Nazia Begum's husband and brother-in-law are having a job abroad and are wealthy persons and that it is possible to extract money and that, therefore, this case was foisted with a mala fide intention to blackmail them to extract money illegally.

It is further contended in the defence that there is no property as shown in the plaint schedule particularly as shown in Schedule 'A, B & C' schedules in survey No.30/1 and that the sale deeds in the names of the plaintiffs are fictitious and that there is no property like the plaint schedule property in existence. 3.3 During the course of enquiry before the trial Court, no documents were exhibited. On merits, the trial Court had dismissed the petition. Therefore, the aggrieved plaintiffs are before this Court. 4.

The learned counsel for the plaintiffs would contend that the trial Court had failed to appreciate that the defendants particularly the 2nd defendant is not claiming any right in the property and that his only contention is that there is no property like the plaint schedule property in existence and that the plaintiffs' sale deeds are only challenged as fictitious sale deeds and that the truth and validity of the sale deeds of the plaintiffs is not seriously disputed and that the trial Court has failed to see that the plaintiffs had purchased the properties under regular sale deeds and that the plaintiffs had established the cardinal principles namely prima facie case, balance of convenience in their favour and irreparable loss that would ensue if no injunction is granted. 5. I have noted the submissions.

No documents were exhibited on either side at the time of hearing of the interlocutory application before the trial Court. Therefore, the contents of the documents of the parties are not adverted to and not considered by the Court below. When an Interlocutory Application is filed for a temporary injunction in regard to immovable property, the Court has to necessarily look into the documents of both the parties and examine the contents thereof to find out as to whether the pleadings find support from the recitals in the respective documents. No just decision as regards the property in dispute can be made without looking into the documentary evidence that may be relied upon by both the parties.

In the light of the contentions urged by both the parties, it is necessary to refer to and carefully examine the recitals in the documents before coming to a just decision in the matter. Unless the documents filed by both the parties are exhibited, the documents will not be sent to this Court from the trial Court along with the lower Court records. Unless the documents are before this Court and are duly exhibited, it is neither possible nor is just and proper to appreciate the rival contentions. The trial Court ought to have allowed the parties to have their documents exhibited before disposing of the petition for temporary injunction on merits.

Even in a case where the parties failed to make a request to exhibit their documents for consideration in the interlocutory application, it is the duty of the Court to see that the necessary documents are exhibited. It is not a case where the parties specifically opted not to exhibit the documents for one reason or the other. Rule 60 of the Civil Rules of Practice says that the enquiry into an interlocutory application shall be conducted by receiving affidavits, but if the Judge directs that the evidence be given orally, then it shall be recorded and the exhibits be marked in the same manner as in the case of suits. This Court in a decision in A.P. Minerals Development Corporation Limited Hyderabad v. M/s.Trimex Minerals Pvt.Ltd.,​ and another decision in Bhopal Reddy and another v. K.

Lakshmi Bhai and another​ held that the practice of marking the documents in the interlocutory application only shall be continued. It is thus obvious that the documents filed by either of the parties shall have to be marked, unless the parties specifically opt for not marking either on the ground of inadmissibility or for some other reasons of their own. In these circumstances, it is just and proper to allow the appeal and remand the matter to the trial Court for disposal of the IA on merits, after following the procedure established by law which was adverted to supra. 6. In this appeal, the plaintiffs filed an application to receive additional evidence. The plaintiffs are permitted to take return of the said documents and file them before the trial Court for consideration in the IA. 7.

For the reasons assigned, the Civil Miscellaneous Appeal is allowed and the order and the decretal order of the trial Court in I.A.No.803 of 2014 are set aside and the said IA is remitted to the trial Court with a direction to give an opportunity to both the parties to exhibit their respective documents and then dispose of the said application afresh, on merits and in accordance with the procedure established by law. It is represented that there is a status quo order in favour of the plaintiffs till the application for temporary injunction was dismissed by the trial Court.

In view of the facts peculiar to the case and as the defendants are contending that the property is not in existence and as the plaintiffs are claiming that they are in possession of the plaint schedule property having acquired the same under registered sale deeds, there shall be status quo as on today in favour of the plaintiffs for one month. The trial Court is directed to dispose of the aforementioned IA as directed supra as expeditiously as possible and preferably within one month from today. Miscellaneous petitions, if any, pending in this appeal shall stand closed. _____________________ M.
