THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5709 of 2019 O R D E R:

This writ petition is filed for the following relief: .....to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 2 and 3 in demolishing the part of the compound wall belongs to the petitioner open land extent of 159. 96 sq. yards in Sy.No.1188, Metpally Village, Karimnagar (Jagityal) District as illegal, arbitrary, against the principles of natural justice without following due process of Municipal Laws and violative of Article 300-A of Constitution of India and consequently direct the respondents 2 and 3 not to interfere with peaceful possession and enjoyment of the land to an extent of open land extent of 159.96 sq.

yards in Sy.No.1188, Metpally Village Karimangar (Jagityal) District including compound wall..." Today, when the matter is taken up, learned Standing Counsel for respondent Nos.2 and 3 submits that the respondent authorities have not interfered with the property of the petitioner and had not demolished the compound wall constructed by her. He further submits that when the petitioner and her neighbour, by name Sri Vittal, were quarrelling, respondent No.3 visited the site to enquire into the dispute and it has come to light that the said Vittal had demolished the compound wall of the petitioner in the process of construction of the former's house.

The above said submissions are made part of the record. In the light of the above, the respondent authorities are directed not to interfere with the property of the petitioner and if the same is required for any purpose, they shall follow due process of

law. Liberty is given to the petitioner to work out her remedies in accordance with law.

Subject to the above, the writ petition is closed. Miscellaneous petitions, if any, pending in this writ petition shall also stand closed. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:19.03.2019 kdl
