HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 46110 of 2016 Order:

This Writ Petition was filed challenging the registration of FIR No.62 of 2016 dated 13.09.2016 on the basis of the complaint made by the third respondent under Section 420 IPC read with Sections 10, 24(1)(b) of the Emigration Act.

This Court carefully perused the complaint and after going through the complaint comes to the conclusion that registration of the FIR cannot be interfered with. Since the matter is under investigation, this Court cannot interfere with the investigation pursuant to registration of the complaint. However, the second respondent shall conduct the investigation only in accordance with law duly complying with the provisions of Section 41-A of the Code of Criminal Procedure while conducting the investigation.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
