HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.5064 OF 2018 ORDER:

Heard learned counsel for the petitioners, learned Government Pleader for Revenue and the learned Government Pleader for Irrigation.

This writ petition is filed seeking the following relief :- "...............Writ of Mandamus declaring the action of the Respondents in seeking to dispossess the Petitioners herein, including by digging and taking away the gravel from the lands admeasuring Ac.34-00 gts in Sy.No.1 to 27 without initiating any acquisition process in accordance with law as being arbitrary, illegal and unconstitutional and consequently direct the Respondents not to interfere with and/or dispossess the petitioners herein from the land admeasuring Ac.34-00 gts in Sy.No.1 to 27 situated at Konney Village, Bachanapet Mandal, Warangal District except in accordance with law and pass such other............."

It has been contended by the petitioners that they own the land admeasuring Ac.34-00 gts in Sy.No.1 to 27 situated at Konney Village, Bachanapet Mandal, Warangal District and the respondents are trying to interfere with their possession without following due process of law.

Therefore, learned counsel for the petitioners contends that appropriate orders be passed in the writ petition directing the respondents not to interfere with the possession of the petitioners without following due process of law.

Learned Standing counsel appearing for the respondents had contended that respondents would interfere with the

possession of the petitioners only after following due process of law.

This Court, having considered the rival submissions of the learned counsel appearing for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents not to dispossess the petitioners without following due process of law.

With the above direction, this writ petition is disposed of. No order as to costs.
