THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL AS MP.No.892 of 2017 & A.S.No.221 OF 2015 JUDGMENT:

The appellants/defendants and the respondents/plaintiffs are present and they are duly identified.

It is represented that the suit filed by the respondents/plaintiff for cancellation of the agreement of sale-cum-General Power of Attorney, dated 28.06.2006 and for cancellation of registered sale deed, dated 05.05.2007 was decreed on 15.11.2014 by the III Additional District & Sessions Judge, Ranga Reddy District in O.S.No.63/2008. Aggrieved thereby, the defendants filed the present appeal. Now, at the intervention of the elders and keeping in view the health conditions of the 2nd respondent, both parties have agreed to compromise the matter, and in terms thereof, a sum of Rs.9,47,820/- by way of demand draft bearing No.549642, drawn on Andhra Bank, Kothapet Branch, Fruit Market, Hyderabad is given by the respondents/plaintiffs to the appellants/defendants. In addition, a net cash of Rs.3 lakh is also paid by the respondents/plaintiffs to the appellants/defendants in open court. In pursuance to the compromise, the keys of the schedule property are also delivered.

The terms of the compromise are read over and explained to both the parties and they admitted that they are true and voluntary, accepted the compromise and in acknowledgment thereof, they put their signatures in open court.

MSKJ,J AS.221 of 2015 In that view of the matter, ASMP No.892/2017 is allowed and the compromise is recorded. Consequently, the appeal is dismissed in terms of the compromise. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
