Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.
The petitioner was appointed as a fair price shop dealer in the year 2011 and a show cause notice was issued to him on 26.08.2016 framing two charges against him. On enquiry, both the charges were held not proved as could be seen from the order passed by the third respondent dated 07.06.2017. Since in the last paragraph of the said order it was stated that an appeal lies to the Joint Collector, the petitioner mistook it as an order against him and approached this Court.
In view of the specific findings in respect of charges 1 and 2 as held not proved, the petitioner is deemed to have been exonerated of the charges.
In the circumstances, the petitioner shall be continued as the fair price shop dealer of shop No.15 of Govardhanagiri Village of Veldurthy Mandal in Kurnool District, unless some other irregularities are noticed and another enquiry is pending. The Writ Petition is, accordingly, allowed. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
