THE HONOURABLE SRI JUSTICE K. LAKSHMAN CRIMINAL PETITION No.228O oF 2O2t ORDER:
This Criminal Petition is liled under Section 482 Cr.P.C. to quash the proceedings in Crime No.675 of 2O2O on the file of RGI Airport Shamshabad Police Station, Ranga Reddy District. Heard the learned counsel for the petitioner and the learned Public Prosecutor Perused the record.
On the complaint lodged by one Shankar Charukonda, the Police have a registered a case in Crime No.6O3 ol 2O2O for the offences under Sections 447, 127, 347,506 read with Section 34 iPC against one M.Ba1 Reddy and the second respondent herein. The very same Police have registered a case in Crime No.368 of 2O2O against the second respondent on :he complaint lodged by the petitioner herein for the offences under Sections 427, 447, 468, 47I and 506 IPC. Again, on the complaint lodged by the second respondent herein, the very same Police registered the present crime for the aforesaid offences. Perusal of the complaints in all the crimes would reveal that there are disputes between the petitioner and the second respondent with regard to land admeasuring Ac.0.08, 0.36 and 1.00 guntas in Sy.Nos.565l A, 566 I Al A and 567 I A respectively situated at Shamshabad Village and Mandal.
Considering the said fact and a-lso the lact that the offences aileged against the petitioner herein are bailable
offences, this Criminal Petition is disposed of directing the Investigating Officer in Crime No.675 of 2O2O on the file of RGI Airport Shamshabad Police Station, Ranga Reddy District, to strictly follow' the procedure laid down under Section 41-A of Cr.P.C. and also the guidelines issued by the Hon'ble Apex Court in a decision reported in ARIVESIf KUMAR V/s, STATE OF BIHARI . Hou,ever, it is made clear that the petitioner shall cooperate with the Investigating Officer in concluding the investigation by furnishing the relevant documents as sought by the Investigating Officer.
