Petitioners claim to be the assignees of land to an extent of Acs.3.69 cents in R.S.No.226/1 of Polasanipalli Village, Bhimadole Mandal, West Godavati District. Petitioners allege that without following due process of law, the respondents have undertaken digging of outlet canal across their land and dispossessing the petitioners and the same is illegal. Petitioners seek a declaration and direction to the respondents to follow due process of law before dispossessing them.

The Tahsildar, Bhimadole Mandal, furnished written instructions to the learned Government Pleader for Revenue vide Roc.No.E-1202998/2018/A signed on 14.02.2018. The content of the letter would disclose that Irrigation Department has taken up precautionary steps to de-silt the tanks under 'NEERU CHETTU' programme in R.S.No.214 to an extent of Acs.12.22 cents at Polasanipalli Village of Bhimadole Mandal and marked the boundaries which are adjacent to the petitioners land and the land of the petitioners is not affected with the said irrigation work. The letter is taken on record.

In view of the categorical assertion of the Tahsildar, Bhimadole Mandal, that the land of the petitioners is not affected by the irrigation work, the cause for apprehension does not subsist.

The Writ Petition is accordingly disposed of as no further orders are required to be passed. There shall be no order as to costs.

Miscellaneous Petition, if any, filed in this Writ Petition shall stand closed.
