THE HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.8849 of 2013 ORDER:

In this Petition filed under Section 482 Cr.P.C., the petitioners/accused Nos.4 & 6 seek to quash the proceedings in Cr.No.56 of 2012 on the file of Mangapet Police Station, Warangal District, whereunder they are charged for the offences under Sections 420, 468 and 471 IPC.

When the matter came up for hearing, learned Public Prosecutor by producing a copy of the charge sheet submitted that the police have filed charge sheet on 27.07.2014 and the learned Judicial First Class Magistrate, Mulug, took cognizance of the same and registered as C.C.No.252 of 2014 and hence, the instant petition, which is filed for quashment of the proceedings, has became infructuous and prayed to dismiss the petition. Upon that, learned counsel for petitioners made an endorsement on the back side of the petition seeking permission of this Court to withdraw the petition with a liberty to file afresh petition questioning the charge sheet.

It is seen that pending Criminal Petition, no stay was granted.

In view of the above respective submissions of both sides, this Criminal Petition, which is filed for quashment of the proceedings in Crime No.56 of 2012, is dismissed as infructuous and liberty is given to the petitioners to challenge the charge sheet by initiating appropriate proceedings.

Consequently, the miscellaneous petitions, if any, pending, in this case, shall stand closed.
