HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5799 of 2019 ORDER:

The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of Respondent authorities in not issuing pattadar passbooks and title deeds by duly considering application of the Petitioner dated 27.12.2005 made in Form No.10 for regularisation of the simple sale deed dated 20.02.1969 of late G.Bharath Reddy in respect of the land admeasuring Acs.12.30 gts in Sy.No.453/1 situated at Thimmapur Village, Kandukur Mandal, now Ranga Reddy District, as illegal, arbitrary, unjust and consequently direct the 4th Respondent to dispose the appeal Case No.A2/909/2018 expeditiously and pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

It appears that the appeal filed by the petitioner under Section 5 (B) of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, has been taken on file by the Revenue Divisional Officer, Kandukur Division, Ranga Reddy District, as Case No.A2/909/2018. The appellate authority also granted a stay order in the said case on 07.7.2018 but the import of the said stay order eludes comprehension. In any event, as the appellate authority is already seized of the matter, it would not be open to the petitioner to approach this Court for any directions in relation to the subject matter of the said appeal.

As this Court does not propose to either entertain the matter for adjudication or go into the merits of the matter, it would not be necessary to put respondent Nos.6 to 8 on notice or afford them an opportunity of hearing.

SK, J WP.No.5799 of 2019 Dt:20.3.2019 It would suffice at this stage if the appellate authority takes up the petitioner's pending appeal and disposes of the same on merits expeditiously keeping in mind the fact that valuable property rights of the parties would be at stake.

The Writ Petition is accordingly disposed of directing the Revenue Divisional Officer, Kandukur Division, Ranga Reddy District, to give priority to the petitioner's appeal in Case No.A2/909/2018 and dispose of the same on merits and in accordance with law, after giving notice and an opportunity of hearing to all parties concerned, expeditiously and in any event, not later than three months from the date of receipt of a copy of this order, be it from whatever source.
