Heard learned counsel for petitioner and Special Standing Counsel for C.B.I.

For the reasons submitted by the learned counsel for petitioner, in the interest of justice, this Petition is allowed and the petitioner/Accused No.3 is directed to appear before Special Judge for CBI Cases, Visakhapatnam, in C.C.No.09 of 2011 on or before 02.04.2015 and on his appearance, the N.B.W issued against him shall be recalled by the trial Court. It is informed that the case is posted to 16.04.2015. Hence, the petitioner/A.3 is directed to appear before the trial Court on the said date, failing which, the trial Court shall take appropriate action against the petitioner/A.3 available under law. As a sequel, miscellaneous applications pending, if any, shall stand closed.
