THE HON'BLE DR.JUSTICE SHAMEEM AKTHER TRANSFER CRIMINAL PETITION NO.43 OF 2018 ORDER:

This transfer criminal petition is filed by the petitioner-accused under Section 407 Cr.P.C. to withdraw C.C.No.277 of 2014, pending on the file of the Principal Judl. Magistrate of I Class, Jangaon and transfer the same to the City Criminal Courts at Nampally, Hyderabad.

Heard learned counsel for the petitioner and perused the record.

Learned counsel for the petitioner would submit that the petitioner met with an accident and suffered head injury and some injuries to lower limbs also and he is not in a position to attend the Court at Jangaon and ultimately, prayed to transfer the above C.C.

What is submitted on behalf of the petitioner is true. He cannot attend the Court at Nampally also. The C.C. is of the year 2014. The C.C. has to be dealt with expeditiously. It appears, the petitioner is not pursuing his remedy expeditiously. There are no grounds to transfer the case to the Court at Nampally. However, the Court below is directed to expedite the disposal of the case. The petitioner is at liberty to file an application to dispense with his personal attendance before the Court below as and when he is unable to attend the Court. On filing such an application, the Court below may consider the same in accordance with law. But, the trial shall not be delayed. 5.

With the above observation, the Transfer Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Petition shall stand closed.
