Heard Mr. G. Ram Gopal for petitioner and the Assistant Government Pleader (Land Acquisition) for respondents.
2. The Assistant Government Pleader places on record the communication Ref A/SWLA/1241/2007 dated 28.08.2016 received by the Officer of the Government Pleader (Land Acquisition). The communication reads as follows:
"In the ref 3rd cited the Tahsildar, Anaparthi has submitted his report stating that the land proposed for acquisition is low lying area and needs leveling, moreover the said land proposed for acquisition is not fit for residential purpose as the poultry is existing opposite to the proposed for acquisition of land for providing house sites to weaker sections people. Hence, at present acquisition of land under SWLA to an extent of Ac.4.00 cents in S.No.19/2, 3, 4 and 20/1 of Mahendrawada Village, Anaparthi Mandal is not useful. In this connection I finally submit that as per the report of the Tahsildar, Anaparthi the land measuring Ac.4.00 cts land in Sy.No.19/2, 3, 4 and 20/1 situated in Mahendrawada Village, Anarpathi Mandal Land Acquisition initiated for providing house sites to weaker section people is not required as the land is low laying and moreover the poultry is existing opposite to the proposed acquisition of land as it is not suitable for residential purpose. Hence, this land acquisition is not required."
3. From the above instructions, it is submitted that the subject land is not acquired by respondents and the same may be placed on record and the writ petition disposed of accordingly.
Having regard to the instructions dated 28.08.2016, the writ petition is disposed of by making interim order as final order. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
