HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.No.7391 of 2015 ORDER:

The petitioner, who is A-2 in OR.No.58 of 2011-12 of S.V. National Park, Tirupati, registered for the offences punishable under Sections 20(i)(ii)(iii)(iv)(viii) & (x) of A.P. Forest Act, 1967; Contravention of Rule 3 and 4 of A.P. Sandal Wood and Red Sanders Wood Transit Rules 1969; Sections 378 and 379 I.P.C., moved this application for anticipatory bail.

The case of the prosecution, in brief, is that on 16.07.2011 at about 4.30 P.M. near Theendragunta locality of Karakambadi beat, the Forest Officials, Tirupathi, stopped Tata Turbo vehicle bearing No.A.P.03 TV 5071 and on inspection they found Red Sander logs numbering 23, weighing about 638 K.Gs. in the said vehicle. It is further stated that the confessional statement of A-1 reveals that the contraband belongs to the petitioner-A2.

Learned Counsel appearing for the petitioner submitted that the petitioner is an employee in Animal Husbandry Department and he was falsely implicated in the case on the alleged confessional statement of A-1 and that there are no specific overt acts attributed against the petitioner-A2.

Learned Public Prosecutor submitted that ever since the date of offence, the petitioner-A2 is absconding and that the trial Court issued Non Bailable Warrant against the petitioner-A2. Having regard to the serious allegations leveled against the petitioner-A2 and considering the gravity of the offence, it is not a fit case to grant anticipatory bail to the petitioner-A2 at this stage. The Criminal Petition is accordingly dismissed. ___________________
