M. Jyothi v. State Of Telangana,
THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.11345 OF 2015 Date:01.05.2015 Between:
M. Jyothi .. Petitioner And State of Telangana, rep., by its Principal Secretary, Home Department, Secretariat, Lower Tank Bund, Hyderabad and others .. Respondents
THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.11345 OF 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Home.
The grievance of the petitioner in this Writ Petition is that though she is no way concerned with F.I.R.No.87 of 2015, respondent No.2, who is the Investigating Officer, and his sub-ordinates are calling her repeatedly to Police Station and pressurising her to pay Rs.2,50,000/- to the complainant.
Learned Government Pleader for Home has received instructions, which state that respondent No.4 has filed a private complaint, which was referred to IX Metropolitan Magistrate, Cyberabad at Kukatpally and based on that, Crime No.87 of 2015 was registered on 10.02.2015 and investigation is pending. It is specifically stated in the instructions that the petitioner is no way concerned with the above case and she is not at all shown as accused in F.I.R. and she appears to be a family friend of accused named therein. The specific allegations of the petitioner that she has to pay the cheque amount on behalf of accused, who is named in the said F.I.R. etc., are denied and it is specifically stated that she is not at all required in connection with the above case.
In view of the above, the Writ Petition appears to have been filed on mere apprehension and, hence, no directions are called for. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
