HONOURABLE SRI JUSTICE S.RAVI KUMAR SECOND APPEAL No.11 of 1998 JUDGMENT:

When this matter is taken up for hearing on 19-12015, as no representation was made, the matter was directed to be posted to 3-2-2015 under the caption "For Dismissal."

From 3-2-2015, it was posted to 10-2-2015 as no representation was made on behalf of both parties. From 10-2-2015, this matter was posted to 16-22015 on the request of advocate for appellants under the same caption.

Today, in the morning hours, a request was made to pass over and the matter was passed over till after lunch. When it is taken up at 2-15 P.M., in spite of matter being listed under the caption "for dismissal" and passed over at request of advocate for appellants, no interest is evinced to prosecute the case.

Hence, this Second Appeal is dismissed for non-prosecution. As a sequel to the disposal of this appeal, the Miscellaneous Petitions, if any, pending, shall stand

dismissed.
