HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 18678 of 2010 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of respondent Nos.1 and 2 in not considering the representation of the petitioner dated 11.06.2010 for pensionary benefits, as illegal and arbitrary.

When the matter is taken up for hearing, it is informed by the Assistant Solicitor General appearing for respondent Nos.1 to 3 that the entire pensionary benefits payable to the husband of the petitioner have already been settled in 2011. Therefore, the writ petition becomes infructuous.

Recording the aforesaid submission, the writ petition is dismissed as infructuous. However, if any benefits are still due to the petitioner, it is always open for her to pursue the remedies.
